Protecting a Business from Costly Litigation
Successful Settlement for Scrutton Bland
Background
Scrutton Bland turned to Sumer Law when an ex-employee initiated the ACAS Early Conciliation process. The employee, who had resigned in June 2024, claimed that workplace stress and lack of managerial support had worsened an acute medical condition, leading to financial and emotional distress. She sought £26,000 in compensation.
However, the business had maintained strong HR records, demonstrating that proper procedures had been followed, and the resignation was voluntary. Additionally, we confirmed that the employee had already secured new employment, further weakening her financial loss claim. Given the potential risks of a tribunal case, we advised a strategic approach to swiftly resolve the matter while protecting the hub’s financial and reputational interests.
Outcome
Senior Employment Law Solicitor, Rhiannon Davies, conducted a thorough assessment of the case and identified that while some claims were arguable, they were ultimately weak. Rather than allowing the case to escalate, Rhiannon recommended a proactive and commercially driven settlement approach.
She issued a firm, strategically worded email directly to the ex-employee, highlighting the flaws in her claim and the potential costs she would face if the case proceeded to tribunal. She made it clear that the proposed settlement reflected the legal costs the hub would otherwise incur in defending the claim. This assertive approach aligned with the hub’s goal of avoiding unnecessary expenses while protecting its position.
Following Rhiannon’s intervention, ACAS confirmed that a settlement had been reached just six days before the tribunal deadline. The ex-employee accepted the hub’s proposed offer, which was formalised through an ACAS COT3 agreement, ensuring confidentiality and preventing any further claims related to her employment.
